What is mediation?
Mediation is an alternative dispute resolution method where an unbiased 3rd party mediator is retained by the parties to facilitate unresolved matters, typically used in divorce and civil proceedings.
Why is it important?
Mediation is essential for various reasons, but the most common is that it facilitates a neutral ground for problem-solving, gives the client a hands-on approach towards the outcome of their case, and reduces litigation and the costs associated with it.
How long is mediation?
Mediation can last anywhere from a half-day (4-5 hours) to a full day (8-10 hours), with the duration depending on the progress made during the session.
Do you enjoy mediation? What do you enjoy about it?
I enjoy mediation because it provides clients with a deeper understanding of the issues hindering a resolution and allows them to take an active role in making key decisions about the outcome of their cases.
Do your clients like mediation? What do they like about it?
Going into mediation, clients are typically unsure, nervous, and anxious, but I believe that, overall, they appreciate it when a final resolution can be reached.
When in the divorce process is mediation?
Typically, after original petitions, counter petitions, and discovery prior to trial.
What is your best mediation outcome?
I don’t think this question can be properly answered, other than to say that in most mediations, neither party will walk away completely satisfied with the result. What they will walk away with is the satisfaction of having had control over the outcome.
